Terms of Service

These Terms of Service ("Terms") govern your use of QMV (Quantum Media Vault), including our applications for macOS, iOS, Windows, Android, and Linux, as well as any associated cloud sync services ("the Service"). By using QMV, you agree to these Terms.
1. Your Account
- You must be at least 16 years old to use QMV.
- You are responsible for maintaining the security of your account credentials.
- You may not share, sell, or transfer your account to another person.
2. Master Password & Recovery Key Responsibility
This is the most important section of these Terms. Please read it carefully.
QMV is a zero-knowledge system. Your master password is used locally to derive your encryption keys. It is never transmitted to or stored on our servers.
- You are 100% responsible for your master password and recovery key. Store them in a safe, offline location (e.g., a printed copy in a safe deposit box).
- If you lose your master password and recovery key, your vault is mathematically locked forever. QMV cannot reset your password. QMV cannot recover your photos, videos, or any encrypted data. There is no backdoor, no override, and no exception.
- QMV is not liable for data loss resulting from forgotten, lost, or compromised credentials. This is a fundamental architectural constraint, not a business decision. Zero-knowledge encryption means zero ability to recover on your behalf.
3. Subscriptions & Billing
3.1 Free Tier (QMV Basic)
QMV Basic is free forever. It includes local vault encryption, basic AI tagging, and support for up to 10 million photos per vault. No credit card is required.
3.2 QMV Pro
- Monthly: $8.99/month, billed monthly.
- Annual: $89.00/year ($7.42/month), billed annually.
- QMV Pro includes encrypted cloud sync, advanced AI tagging and search, unlimited photos and videos, multi-device sync, hardware security key support, and priority support.
3.3 Refunds
Monthly subscriptions may be cancelled at any time. You will retain access to QMV Pro features through the end of your current billing period. Annual subscriptions are eligible for a full refund within 14 days of purchase if you have not used the sync service. After 14 days, annual subscriptions are non-refundable but may be cancelled to prevent renewal. Refund requests should be sent to [email protected].
4. Acceptable Use
While QMV's zero-knowledge architecture means we cannot inspect your encrypted content, you agree that you will not use the Service to:
- Store, distribute, or facilitate the distribution of child sexual abuse material (CSAM) or any content that exploits minors.
- Store or distribute material that violates applicable laws in your jurisdiction.
- Attempt to reverse-engineer, decompile, or tamper with QMV's encryption protocols or security infrastructure.
- Use the Service to conduct or facilitate illegal activity.
If we receive a valid legal order establishing that an account is being used for illegal purposes, we reserve the right to terminate that account.
5. Intellectual Property
QMV, the QMV logo, and "Quantum Media Vault" are trademarks of QMV. The QMV application, including the QMV engine, is proprietary software. You retain full ownership of all content you encrypt and store using QMV. We claim no intellectual property rights over your data.
6. Limitation of Liability
To the maximum extent permitted by applicable law:
- QMV is provided "as is" and "as available" without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
- QMV shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data, loss of profits, or loss of access to encrypted content due to forgotten credentials.
- Our total aggregate liability for any claims arising from your use of the Service shall not exceed the amount you paid to QMV in the twelve (12) months preceding the claim.
7. Termination
- You may delete your account and terminate these Terms at any time via the QMV app settings or by contacting [email protected].
- We may terminate or suspend your account if we reasonably believe you have violated these Terms or applicable law.
- Upon termination, your right to use the Service ceases immediately. Encrypted sync data will be deleted from our servers within 90 days. Local vault data on your device is unaffected.
8. Governing Law
These Terms are governed by and construed in accordance with the laws of the jurisdiction in which QMV is incorporated, without regard to conflict of law principles. Any disputes arising under these Terms shall be resolved in the courts of that jurisdiction.
9. Changes to These Terms
We may update these Terms from time to time. We will notify you of material changes via the QMV application or by email at least 30 days before they take effect. Your continued use of QMV after changes are effective constitutes acceptance of the updated Terms.
